1. Introduction and Scope
Pryme Pay LLC ("Pryme Pay," "we," "us," or "our") provides merchant services, payment technology solutions, and related support services to small and medium-sized businesses. Pryme Pay partners with participants across the electronic payment processing ecosystem, including multiple front-end and back-end processors, payment device encryption facilities, registered Merchant Service Providers (MSPs), acquiring banks, and point-of-sale software providers. Our role is to curate, market, deliver, and service each component of the payment acceptance solutions deployed to our merchant customers, end to end.
This Privacy Policy describes how we collect, use, disclose, and protect information in connection with:
Our websites and online portals (collectively, the "Sites")
Merchant applications, onboarding, and underwriting
Merchant account servicing, reporting, and support
Our relationships with affiliates, referral partners, and Independent Sales Agents ("Partners")
This Policy applies to business representatives, owners, principals, guarantors, and authorized contacts of the businesses we serve, as well as visitors to our Sites and representatives of our Partners. By applying for or using our services, or by using our Sites, you acknowledge the practices described in this Policy.
This Policy does not apply to the independent privacy practices of our processing partners, acquiring banks, card networks, or other third parties, each of which maintains its own privacy policy.
2. Who We Are and How Payments Flow
Pryme Pay curates, delivers, and services complete payment acceptance solutions. Actual payment processing, authorization, settlement, and funding are performed by merchant acquirers and front-end processors, which connect merchants to payment networks, route authorization requests, and handle transaction capture, and by issuer and back-end processors, which provide core services to card-issuing banks including authorizations, ledger postings, and funds settlement, together with sponsoring acquiring banks, not by Pryme Pay.
Pryme Pay does not collect, store, process, or transmit cardholder data. Payment card numbers, card verification values, and related consumer payment credentials flow directly between the merchant's point-of-sale or payment environment and the payment processing platforms operated by our partners. Cardholder data is never downloaded to or stored on systems owned by Pryme Pay.
Pryme Pay does, however, service every aspect of the payment solutions deployed to its merchants, end to end. When a merchant service request involves cardholder data or transaction detail, Pryme Pay fields and resolves the request directly, working within its partners' secure, PCI DSS-compliant portals and environments. This allows Pryme Pay to access the information necessary to resolve the request and deliver the required outcome without cardholder data ever residing on Pryme Pay systems, removing complexity for our merchants.
3. Information We Collect
Business Information
Legal business name, DBA, entity type, and formation details
Federal tax identification number (EIN)
Business address, phone number, email, and website
Industry, merchant category, products and services sold
Estimated and actual processing volumes, average ticket size, and sales channels
Bank account information for settlement and billing (account and routing numbers)
Personal Information of Owners, Principals, and Guarantors
As required for merchant underwriting, identity verification, and regulatory compliance, we collect personal information about business owners, officers, control persons, and personal guarantors, including:
Full legal name, date of birth, and Social Security number
Home address, phone number, and email address
Ownership percentage and title
Government-issued identification details, including copies of documents such as a driver's license or passport
Supporting documentation submitted with orders and merchant applications, such as proof of business ownership, voided business checks, and proof of identity documents
Credit history and background information obtained from consumer reporting agencies and identity verification services, with authorization provided in the merchant application
Account and Servicing Information
Merchant account numbers and identifiers assigned by our processing partners
Processing activity summaries, statements, deposits, chargebacks, and fee information provided to us by our processing partners for servicing and reporting purposes
Support requests, correspondence, and records of communications with us
Equipment, terminal, gateway, and software configuration details
Partner Information
For affiliates, referral partners, and Independent Sales Agents, we collect contact information, business details, tax information required for compensation reporting, and records related to referred merchants and residual compensation.
Website and Technical Information
When you visit our Sites, we and our service providers automatically collect device and usage information, including IP address, browser type, operating system, pages viewed, referring pages, and date and time stamps, through cookies and similar technologies described in Section 8.
Information from Other Sources
We receive information from our processing partners, acquiring banks, card networks, consumer reporting agencies, identity verification providers, fraud prevention services, public records, and our Partners in connection with referrals and account servicing.
4. How We Use Information
We use the information we collect to:
Evaluate, process, and submit merchant applications for underwriting
Verify identity and conduct due diligence required by law, card network rules, and processor requirements, including Know Your Customer (KYC), anti-money laundering (AML), and Office of Foreign Assets Control (OFAC) screening
Establish, service, and maintain merchant accounts
Provide reporting, statements, and account support
Configure and support payment equipment, gateways, and software
Calculate and pay Partner compensation and residuals
Communicate with you about your account, services, and support matters
Market our products and services, subject to your opt-out rights
Detect and prevent fraud, unauthorized activity, and violations of our agreements
Comply with legal, regulatory, card network, and contractual obligations
Operate, secure, and improve our Sites and internal operations
5. How We Share Information
We do not sell personal information. We share information only as described below.
Processing Partners and Acquiring Banks. We share merchant application data, business information, and personal information of owners and principals with front-end and back-end processors, registered MSPs, acquiring banks, and card networks as required to underwrite, board, and maintain merchant accounts.
Affiliates, Referral Partners, and Independent Sales Agents. Where a merchant was referred to us by a Partner, we may share application status, account status, and account reporting information with that Partner for purposes of servicing the relationship and calculating compensation. We do not share Social Security numbers, dates of birth, or consumer report information with Partners.
Service Providers. We use third-party providers for functions such as identity verification, credit reporting, document signing, cloud hosting, data storage, communications, accounting, and customer support. These providers are permitted to use information only to perform services for us.
Legal and Compliance. We may disclose information to comply with applicable law, regulation, subpoena, or legal process; to respond to requests from government authorities; to enforce our agreements; or to protect the rights, property, or safety of Pryme Pay, our clients, or others.
Business Transfers. If Pryme Pay is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality protections.
With Your Direction or Consent. We share information with other parties when you direct us to do so or otherwise consent.
6. Gramm-Leach-Bliley Act Notice
Pryme Pay provides financial services and treats nonpublic personal information of individuals connected to our merchant accounts in accordance with the federal Gramm-Leach-Bliley Act (GLBA) and its implementing regulations. We do not disclose nonpublic personal information about current or former customers to nonaffiliated third parties except as permitted or required by law, including disclosures necessary to effect, administer, or enforce the transactions and services you request. We maintain administrative, technical, and physical safeguards designed to protect this information, as described in Section 10.
7. Your Communication Choices
You may opt out of marketing emails by using the unsubscribe link in any marketing message or by contacting us at the address in Section 14. We will continue to send transactional and account-related communications, such as application status, statements, compliance notices, and support responses, which are necessary to service your account.
8. Cookies and Website Tracking
Our Sites use cookies, pixels, and similar technologies to operate the Sites, remember preferences, analyze usage, and support marketing. You can control cookies through your browser settings, though disabling cookies may affect Site functionality. Our Sites do not currently respond to browser "Do Not Track" signals; however, where required by state law, we honor opt-out preference signals such as the Global Privacy Control for interest-based advertising, as described in Section 9.
9. State Privacy Rights
Depending on your state of residence, you may have rights under state privacy laws, including the California Consumer Privacy Act as amended (CCPA/CPRA), the Texas Data Privacy and Security Act, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and similar laws in other states.
Important limitation. Most of the personal information Pryme Pay collects is gathered in connection with providing financial services and is subject to the GLBA. Information collected subject to the GLBA is generally exempt from state consumer privacy laws. The rights below therefore apply primarily to personal information we collect outside of our financial services activities, such as website visitor data and marketing data.
Where applicable, and subject to verification of your identity, you may have the right to:
Know and access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom it is shared
Correct inaccurate personal information
Delete personal information, subject to legal and contractual retention requirements
Portability, meaning to receive a copy of your personal information in a usable format
Opt out of the sale of personal information, the sharing of personal information for cross-context behavioral advertising, and certain profiling. Pryme Pay does not sell personal information and does not share personal information for cross-context behavioral advertising.
Non-discrimination for exercising your rights
Appeal a denial of your request, where provided by your state's law
To exercise these rights, contact us using the information in Section 14. We will respond within the timeframe required by the applicable law. You may designate an authorized agent to submit requests on your behalf where permitted; we will require proof of authorization and may require you to verify your identity directly.
10. Data Security
We maintain administrative, technical, and physical safeguards designed to protect the information we hold, including access controls, encryption of sensitive data in transit and at rest, secure cloud infrastructure, and restrictions limiting access to personnel with a business need. Because Pryme Pay does not store or transmit cardholder data, consumer payment card information remains within our partners' PCI DSS-compliant environments. When servicing merchant requests that involve such data, Pryme Pay works within those secure, compliant environments rather than transferring cardholder data to its own systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you as required by applicable law.
11. Data Retention
We retain information for as long as needed to service your account and relationship with us, and thereafter as required to comply with legal, regulatory, tax, card network, and contractual obligations, resolve disputes, and enforce our agreements. Merchant application and underwriting records, including supporting documentation, are retained in accordance with the requirements of our processing partners, acquiring banks, and applicable law. This applies to approved accounts as well as applications that are declined, withdrawn, or cancelled, which are retained for the period required by applicable recordkeeping and adverse action requirements. When information is no longer required, we delete it or de-identify it using reasonable methods.
12. Children's Privacy
Our services and Sites are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us and we will delete it.
13. Third-Party Websites and Services
Our Sites may link to third-party websites, including those of our processing partners, Partners, and technology providers. This Policy does not apply to those sites, and we are not responsible for their privacy practices. Review the privacy policy of any third-party site you visit.

15. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date above and post the revised Policy on our Sites. Where required by law, we will provide additional notice. Your continued use of our services after changes take effect constitutes acceptance of the revised Policy.
